Updated: 27 October 2026. To check company name availability in India, first search existing company/LLP names using MCA's public name-search service and check potentially conflicting trademarks on IP India's registry. For formal reservation of a new company name, apply through SPICe+ Part A on MCA21 V3. The separate RUN service is primarily for a proposed name change of an existing company. A clean search result is not an approval or trademark clearance.
You may have already decided what to call your business, printed a logo or bought a domain. But before you incorporate a private limited company, one-person company (OPC) or public company, the name must satisfy the Companies Act, 2013, the Companies (Incorporation) Rules, 2014, and the Ministry of Corporate Affairs' name examination requirements. An apparently unique spelling can still be rejected if it is too similar to another company or conflicts with a trademark.
This guide shows how to run a free MCA name search, investigate confusingly similar names, screen trademarks, prepare a stronger application and submit SPICe+ Part A without mistaking a preliminary search for formal approval.
Quick answer: where to check and how to reserve a company name
| Your question | Best official route | Login / payment |
|---|---|---|
Does a similarly named company or LLP exist? | Preliminary search is publicly accessible | |
What are the details of a registered company? | MCA portal Official ↗ → View Company/LLP Master Data | Public company information |
Is the brand already used as a trademark? | Current public search uses OTP verification | |
How do I reserve a name for a new company? | MCA21 V3 → SPICe+ Part A | MCA account; applicable filing fee |
How do I incorporate immediately? | SPICe+ Part A and Part B together | MCA account and incorporation filing |
How do I reserve a changed name for an existing company? | RUN | MCA account; applicable fee |
What about a new LLP? | MCA's applicable RUN-LLP / FiLLiP workflow | Different from company SPICe+ |
Bottom line: The search tells you what is already recorded. Only the competent MCA authority can approve and reserve a proposed company name.

1. What does “company name availability” actually mean?
There are three different tests, and passing one does not automatically mean passing the others.
- Record search: Does a company or LLP with the same or a confusingly similar name already appear in MCA records?
- Legal acceptability: Does the proposed name comply with section 4 of the Companies Act and the applicable rules about resemblance, restricted expressions and undesirable names?
- Trademark risk: Could using the proposed name conflict with an earlier trademark, including a pending application or rights built through use?
For example, a search may return no company named “BluePeak Renewable Energy Private Limited”, but a similarly pronounced company name or an existing “BluePeak” trademark for related services can still present a problem. Name availability, name reservation and trademark registration are separate outcomes.
2. Check company or LLP names on MCA — step by step
The official MCA Check Company/LLP Name page Official ↗ provides a search field for company/LLP names. Its displayed results can include a legal name, CIN/FCRN/LLPIN/FLLPIN, previous name and status. The page advises searching with meaningful keywords rather than relying on entity suffixes.
Steps for a useful preliminary check
- Open the MCA name-search link above, or go through MCA Services from mca.gov.in Official ↗.
- Enter the most distinctive word in the proposed name, not only “Private Limited” or “Enterprises”.
- Review the matching company and LLP names, including previous names and status where displayed.
- Search complete name variants: spelling changes, plurals, singulars, abbreviations, joined/separated words and phonetic alternatives.
- Repeat the process with the two or three strongest alternatives before paying for formal reservation.
- Save relevant results and make a short note of similarities that may need explanation in SPICe+.
Example: search beyond the exact spelling
Suppose the proposed name is “Elvanta Engineering Private Limited” (illustrative). Search for:
- Elvanta and Elvanta Engineering;
- Elventa, Elvante and plausible sound-alike versions;
- Elvanta Engineers, Elvanta Engineering Solutions and similar combinations;
- corresponding LLP names, not only private companies.
A search with no exact result is not enough. Under the name-similarity rules, certain cosmetic changes may be disregarded when MCA compares proposed names.
Use the distinctive brand word as the primary search term. Adding “India”, “Global”, “Services”, “Technologies” or “Private Limited” may not cure a genuine similarity problem.
3. Understand Companies Act section 4 and Rules 8, 8A and 8B
The principal statutory framework is section 4 of the Companies Act, 2013, read with the Companies (Incorporation) Rules, 2014. For practical screening, these rules matter most:
| Provision | Practical issue to screen |
|---|---|
| Section 4 | Names identical or too nearly resembling an existing company, undesirable names, and words suggesting prohibited government association |
| Rule 8 | Names considered too nearly resembling existing company names |
| Rule 8A | Undesirable names, including specified trademark and other public-interest concerns |
| Rule 8B | Certain words/expressions that need previous Central Government approval |
MCA's published Rule 8 material Official ↗ explains that changing features such as letter case, spacing, punctuation, common company suffixes, certain grammatical forms or some generic/geographic terms may not make a proposed name distinguishable. Specific exceptions and consent provisions must be assessed under the full rule.
Similarity is broader than an identical-name match
| Proposed approach | Why approval may be difficult |
|---|---|
| Change “Private Limited” to “Limited” | Suffix differences may be disregarded |
| Change “Tech” to “Technology” or a spelling variant | Similar words and pronunciation can still cause resemblance |
| Add dots, hyphens or spacing | Punctuation and spacing often do not differentiate a name |
| Add a city, “India” or “Global” | Generic/geographic additions may not remove a conflict |
| Add “New” or a number to a well-known name | May still be confusing or restricted under the rules |
| Copy a well-known brand with a different company suffix | Trademark and public-confusion objections remain possible |
Not every similar-sounding proposal is automatically prohibited. The proper test depends on the exact words, registered records, activity and applicable rule. The examples above are screening illustrations, not MCA approval decisions.
4. Check trademarks separately on IP India
Company incorporation approval does not register a trademark. Before paying for name reservation, run a trademark search using IP India's official trademark facility Official ↗.
The current search interface may ask for an email address or mobile number, captcha and OTP before access. Do not use obsolete instructions that describe every trademark search as a completely login-free text box.
How to screen trademark risks
- Open the official trademark public-search service.
- Complete the email/mobile OTP validation displayed by the portal.
- Search the word mark, including spacing and phonetic variants.
- Check the relevant Nice classes for what your proposed company will actually sell or provide.
- Review the status and coverage of potentially conflicting applications or registrations.
- Consider whether an earlier mark is well known or used commercially even outside the closest class.
- Where a conflict appears, obtain a qualified trademark assessment rather than assuming a consent letter will guarantee MCA approval.
For example, a software business should not check only the technology-related name in MCA. Trademark searches may need relevant software, software-service and business-service classes depending on the actual offering.
Read about TaxQue trademark registration support if you want to protect the name separately after clearing the legal risks.
5. Choose a name that fits the company type and business objects
A name should align with the company's principal proposed objects and its legal structure. Do not select a name solely because it ranks well in a search engine.
A practical format: distinctive identifier + meaningful activity word (when useful) + applicable statutory entity ending.
For illustration:
- Nivora Industrial Services Private Limited — a potentially distinctive coined word plus industrial activity;
- Asterline Foods Private Limited — a proposed brand plus food-related activity;
- Mireva Engineering (OPC) Private Limited — a possible OPC-style concept, subject to the portal's required naming conventions.
These are fictional examples, not verified available names. Search and check each proposed name before use.
Certain sector-related names—such as those suggesting banking, insurance, stock exchanges, regulated financial services, government bodies or professional institutions—may call for sectoral consent or statutory approval. Words suggesting government patronage also deserve particular caution.
A Section 8 company follows the permitted naming and licensing conditions for that category; do not automatically apply ordinary private-company suffix rules to every special company structure.
6. SPICe+ Part A: how to reserve a new company name
MCA's official SPICe+ and linked-filings V3 FAQs Official ↗ identify SPICe+ Part A as the new-company name-reservation section and Part B as the subsequent incorporation section.
Route A: reserve the name first
Choose separate Part A filing when you want name certainty before assembling all incorporation forms.
- Create or log in to the MCA V3 account. Some incorporation and DSC-linked steps require the appropriate Business User profile.
- Start SPICe+ and choose the applicable proposed company type, class and category.
- Open Part A and enter the preferred proposed company name and principal business activity.
- Where filing Part A separately, enter up to two proposed names in the available fields.
- Prepare any required clarification or authority/consent documents if your proposed name raises a statutory issue.
- Validate the application and pay the prescribed name-reservation fee.
- Save the Service Request Number (SRN) and monitor MCA application history for approval or resubmission.
- Once approved, continue with Part B and linked incorporation filings within the applicable reservation period.
Only one proposed name is approved/reserved from an eligible separate application. Two proposals are alternatives, not two reservations.
Route B: name reservation together with incorporation
SPICe+ Part A can also be completed together with Part B. MCA's V3 FAQ explains that only one name can be entered in this combined route. This is often more convenient when directors' details, registered-office documents and linked incorporation forms are already prepared.
Portal menus and validation messages may change. Always follow the live MCA V3 workflow and use the current instruction kit rather than an old screenshot.
7. MCA name reservation fee, validity and extension
The normal name-reservation rules must be separated from professional charges, incorporation fees and stamp duty.
| Item | Ordinary MCA position | Important limitation |
|---|---|---|
Free preliminary company/LLP name search | No government search charge | Does not reserve the name |
Separate SPICe+ Part A name reservation | ₹1,000 | Check the live MCA fee screen for the chosen application |
Number of proposals in separate Part A | Up to 2 | Only 1 name may be approved |
Combined Part A + Part B | 1 proposed name | Incorporation-linked fees are distinct |
Ordinary reservation validity after approval | 20 days | Track the actual approval/expiry dates |
Extend from 20 to 40 days | ₹1,000 | Apply before the initial reservation expires |
Extend from 40 to 60 days | ₹2,000 | Apply before the extended period expires |
Extend directly from 20 to 60 days | ₹3,000 | Apply before the first 20 days expire |
The paid extension options above are described in MCA's SPICe+ V3 FAQ. The corresponding dashboard displays the available Extend action for an approved Part A SRN. A fee paid for reservation or an extension is not a guarantee of eventual company incorporation.
Worked example: name-reservation calendar
Assume MCA approves a separate Part A application on 1 November 2026. The ordinary reservation is for 20 days from approval, subject to the portal's displayed expiry calculation. If incorporation documents will not be ready, request the appropriate paid extension before that displayed deadline. Do not rely on an informal assumption about whether the approval date counts as day one.
A June 2026 relief that should not be confused with the normal rule
MCA announced temporary relief following a June 2026 data-centre disruption. Selected reservations and resubmission deadlines were extended to 10 July 2026. This expired, event-specific relaxation is not a permanent change to 20-day name reservation; applicants filing now should follow the currently applicable portal deadline. See the MCA homepage notice archive Official ↗.
8. RUN, RUN-LLP and SPICe+: what's the difference?
| MCA workflow | Primarily for |
|---|---|
| SPICe+ Part A | Name reservation for a new company |
| SPICe+ Part A + B | New-company name approval and incorporation together |
| RUN (Reserve Unique Name) | Name change of an existing company |
| RUN-LLP / applicable FiLLiP process | LLP name-reservation and incorporation needs |
An LLP is a different legal form from a company. If your goal is an LLP, start with the correct LLP workflow rather than filing a company SPICe+ application. TaxQue also provides LLP registration assistance.
9. Documents and information to prepare before applying
You do not need the entire company incorporation document pack simply to do a public name search. Formal reservation and later incorporation, however, require structured information.
For preliminary checking
- ○ Two or three distinctive proposed name options
- ○ Intended business activities and industry description
- ○ Expected company type (private, public, OPC, Section 8 or another applicable category)
- ○ Search results for similar MCA company/LLP names
- ○ Trademark search notes, classes and possible conflicts
For SPICe+ Part A and a connected incorporation filing
- ○ Appropriate MCA V3 user login
- ○ Proposed name(s) in the portal's required format
- ○ Accurate proposed business-object description
- ○ Company type, class and category
- ○ Supporting consent, NOC or regulatory approvals where legally needed
- ○ Payment method and SRN tracking arrangement
- ○ Director/subscriber and registered-office paperwork for the later Part B stage
An applicant should not upload unrelated identity documents or pay for services before confirming what the actual portal asks for in that transaction.
10. Why company names get rejected — with better alternatives
| Common issue | Illustration | Better practice |
|---|---|---|
Exact or close MCA resemblance | “Asteron Tech” versus an existing similar company | Create a clearly new distinctive word |
Minor punctuation or grammatical variation | “Asteron-Tech” versus “Asteron Tech” | Change more than punctuation |
Trademark conflict | Existing similar mark for closely related services | Examine legal risks and consider another name |
Generic or weakly distinctive name | “Best Consulting Services” | Add an original brand element |
Restricted governmental implication | Name suggests official government affiliation | Remove misleading wording and follow approval rules |
Regulated-sector language | “Bank” or “Insurance” used without suitable basis | Obtain the required sectoral approvals or choose accurate wording |
Objects mismatch | A proposed financial-services name with unrelated objects | Align proposed name and legally supportable objects |
Reservation expired | Incorporation filed after approved-name validity | Extend on time or make a fresh application as appropriate |
Case study A: same name, different company type
A founder proposes “Orbel Systems Private Limited” and finds “Orbel Systems LLP”. The company and LLP suffixes do not automatically eliminate similarity or trademark risks. The applicant should assess the distinctive words and legal objections instead of assuming that different legal structures guarantee clearance.
Case study B: different spelling, same pronunciation
“Kwikra Solutions” and “Quickra Solutions” may cause concern if the names sound alike and relate to similar activities. Check pronunciation and other resemblance factors; do not rely only on exact-character matches.
Case study C: domain available, company name not necessarily available
A .in or .com domain may be unregistered even when the relevant company or trademark rights already exist. Buying the domain first does not create an entitlement to MCA name approval.
11. What to do if MCA raises a resubmission or rejects the name
- Read the specific objection shown in MCA application history or the communicated remarks.
- Check whether the issue concerns MCA name similarity, trademark conflict, the proposed objects, restricted words or insufficient documents.
- If a response or revised name is allowed, act within the actual portal resubmission timeline. Do not assume there is a universal, indefinitely renewable resubmission period.
- Provide a concise, factual explanation and any appropriate documentary support.
- Where resemblance cannot reasonably be resolved, select a genuinely different brand name rather than resubmitting cosmetic variations.
- Keep the SRN and payment record. If the application is finally rejected, review the portal's fresh-application route and current fee implications.
MCA name examination involves regulatory judgment. Neither a clean public search nor a consultant can promise a 100% approval rate.
12. After approval: what must happen next?
Approval of the proposed name does not mean the company has been incorporated. The next steps typically involve:
- completing SPICe+ Part B and relevant linked filings;
- preparing director/subscriber information, declarations and registered-office details;
- completing applicable e-MoA/e-AoA or other prescribed documents;
- arranging digital signatures and authorisations where applicable;
- paying the applicable incorporation fees and state stamp duty;
- obtaining the Certificate of Incorporation and CIN after government approval.
The name becomes part of the registered entity's legal identity on successful incorporation, not simply on payment of a name-reservation charge.
An OPC founder can review TaxQue's OPC registration service; founders seeking a public-company structure can see public limited company registration.
13. Name-selection checklist you can use before paying MCA fees
- ○ The name contains a distinctive brand element.
- ○ Exact spelling searched on MCA.
- ○ Singular/plural, phonetic and abbreviated variants checked.
- ○ Existing LLPs and former names reviewed.
- ○ Relevant trademark classes checked on IP India.
- ○ No unjustified claims of government, banking or regulated authority.
- ○ Name is consistent with the actual proposed business objects.
- ○ Applicable company suffix/type selected correctly.
- ○ Two strong alternatives prepared if using separate SPICe+ Part A.
- ○ MCA fee and expected professional charges separately understood.
- ○ Reservation SRN and expiry-date tracking planned.
- ○ Marketing materials held back until realistic approval risks are assessed.
14. MCA name search vs trademark search vs domain availability
| Check | What it tells you | What it does not guarantee |
|---|---|---|
MCA company/LLP search | Publicly recorded company/LLP names and related entries | Formal name reservation or approval |
IP India trademark search | Registered/pending marks and potential conflict indicators | A complete freedom-to-operate or legal clearance opinion |
Domain name search | Whether an internet domain can be registered | Rights under company or trademark law |
SPICe+ Part A approval | MCA name reservation for the specified new-company application | A trademark registration or Certificate of Incorporation |
The safest approach is to treat these checks as complementary, not substitutes for one another.
