Trademark Renewal

Under Section 25 of the Trade Marks Act, 1999, a registered trademark must be renewed every 10 years from the original application date. Renewing on time extends your legal ownership and exclusive brand monopoly indefinitely in 10-year increments.

You can apply for renewal at any time within 6 months prior to the expiration date of the 10-year registration period by filing Form TM-R with standard government fees.

If you miss the deadline, you have a 6-month grace period from the expiration date to file Renewal with Surcharge (Late Fee) via Form TM-R. If the 6-month grace period also lapses, the mark is marked 'Removed' from the register, and you must apply for Restoration under Section 25(4) within 1 year of expiration.

If your trademark was removed for non-renewal, you can apply for Restoration and Renewal within 1 year from the date of expiration by filing Form TM-R along with an affidavit explaining the genuine delay.
