Patent Registration

A Patent is an exclusive statutory monopoly granted under the Patents Act, 1970, for an invention that is a new product or process, involves an inventive step (non-obviousness), and is capable of industrial application. Registering a patent grants a 20-year exclusive commercial monopoly, prohibiting rivals from making, using, selling, or importing your invention.

A Provisional Specification (Form 2) is filed to secure an immediate, legally binding Priority Date at early innovation stages with minimal disclosure. You then have a strict statutory window of 12 MONTHS to develop the invention and file the Complete Patent Specification with detailed patent claims. Failing to file the Complete Specification within 12 months causes the application to lapse.

Under Section 53 of the Patents Act, every granted patent is valid for 20 years from the date of filing the patent application (subject to payment of annual renewal annuities from the 3rd year onwards).

Under Section 3, you cannot patent: Frivolous inventions contrary to natural laws, discovery of scientific principles, mere discovery of new forms of known substances (Section 3(d)), agricultural methods, mathematical methods, business methods, computer algorithms/software per se (Section 3(k) unless integrated with novel hardware), medical treatment methods, or atomic energy inventions.
