GST Revocation

Estimated timeline *3–5 Working Days

Estimated delivery

Timeline conditions

The estimated 3–5 working days cover application review, preparation and submission, starting after we receive the cancellation order, GSTIN, applicable return-filing details, supporting documents, GST portal access and payment. The ₹1,499 package covers one Form GST REG-21 application for one GSTIN cancelled by the GST Department on its own motion, where the applicant meets the conditions for revocation under Section 30 of the CGST Act and Rule 23 of the CGST Rules. The normal deadline is 90 days from service of the cancellation order. An extension of up to 180 additional days may be available with competent-authority approval. Delayed or disputed applications requiring separate extension proceedings are not included in this fixed-price package. Where cancellation is due to non-filing, the necessary pending returns must be filed and the applicable tax, interest, penalty and late fees paid before the revocation application. TaxQue can check the status of those compliances, but actual return preparation, filing, reconciliation and statutory payments are excluded and quoted separately. The package includes reviewing the cancellation reason, checking eligibility and basic compliance readiness, preparing the revocation grounds, filing Form GST REG-21, providing the ARN and routine application-status guidance. There is no government application fee for REG-21. Applicable GST on TaxQue's professional fee is extra. Written replies to substantive departmental notices, officer hearings, appeals, legal representation, pending GST returns and additional tax computations are not included. The quoted timeline covers professional filing work only. The GST officer may seek clarification or additional documents and may approve or reject the application. Restoration of the GSTIN and the date of the final order cannot be guaranteed. This service does not apply to voluntary GST cancellation or a registration that is only suspended but not cancelled.

GST Registration Revocation & Re-Activation

Under Section 30 of the Central Goods and Services Tax (CGST) Act, 2017 read with Rule 23 of the CGST Rules, any registered taxpayer whose GST registration has been cancelled suo-motu by the proper officer—typically due to continuous non-filing of returns or failure to furnish bank details—can apply for Revocation of Cancellation of Registration in Form GST REG-21.

TaxQue provides end-to-end revocation and reactivation assistance. Our team clears your overdue return backlogs, computes exact tax liability with interest under Section 50, drafts a legally defensible application explaining the genuine cause of delay, and represents your case before the jurisdictional tax officer to restore your active GSTIN.

What is GST Revocation?

GST Revocation is the legal restoration procedure allowing taxpayers facing suo-motu cancellation to reactivate their GSTIN, unfreeze bank accounts, and resume legal invoicing and input tax credit claims.

GST Revocation — GST Registration, Return Filing & GST Notice Resolution in India — TaxQue

Suo-Motu Cancellation Reasons: Initiated by the tax officer when a regular taxpayer fails to file returns for continuous 6 months (or 2 quarters under QRMP) or breaches Rule 21 rules.

Mandatory Pre-Condition for Revocation: Under the First Proviso to Rule 23(1), all overdue returns must be filed and all outstanding taxes, interest, late fees, and penalties must be fully paid prior to applying for revocation.

Statutory Time Limits (90 Days Window): Application in Form GST REG-21 must be filed within 90 days from the date of service of the cancellation order (extendable up to a further 180 days by the Joint/Additional Commissioner upon sufficient cause).

Section 30 Revocation Deadline Warning

If the statutory time limit for filing revocation expires, the taxpayer permanently loses the right to apply for revocation and must file a formal legal appeal in Form GST APL-01 before the Appellate Authority under Section 107.

FAQ

Frequently Asked Questions

Quick answers about GST Revocation

Revocation of Cancellation is the official legal procedure under Section 30 of the CGST Act to restore a GST registration that was cancelled suo-moto by the tax department (usually due to non-filing of monthly returns). You can apply for revocation using Form GST REG-21 within the statutory window.

Under amended Section 30 rules, you must apply within 30 days from the date of the cancellation order. The Joint/Additional Commissioner can extend this by another 30 days, and the Commissioner can grant an additional 30-day extension, providing a total window of up to 90 days. TaxQue helps you secure necessary condonation approvals.

Yes. Under First Proviso to Rule 23(1), you must pay all overdue tax liabilities along with applicable interest under Section 50 and late fees under Section 47 for all past pending periods before the officer will restore your active GSTIN. TaxQue calculates your exact minimal liability.

If the 90-day statutory window has lapsed, standard revocation on the GST portal is blocked. However, you can file a statutory Appeal under Section 107 before the Appellate Authority within 3 months to seek restoration. Our senior tax advocates handle both Section 30 revocations and Section 107 appeals.

Under Section 29(2), the department cancels a GSTIN suo-moto if a regular taxpayer fails to file returns for 6 consecutive months (or 3 consecutive quarters for QRMP/Composition), or if the business obtained registration through fraud, or failed to commence business within 6 months. We review your cancellation order (REG-19) to identify the exact cause.
