ESI Registration

Under Section 2(12) of the Employees' State Insurance Act, 1948, ESIC registration is legally mandatory for any non-seasonal factory or commercial establishment (shops, restaurants, hotels, IT companies, private hospitals) employing 10 or more employees (20 or more in certain states like Maharashtra) located in an ESIC-implemented area.

Employees earning a gross monthly wage (basic + allowances) up to ₹21,000 per month (or up to ₹25,000 per month for persons with disabilities) are mandatorily covered under the ESI scheme. Employees earning above ₹21,000 are exempt from ESIC deductions.

The statutory contribution rates are: Employee Share: 0.75% of gross monthly wages; Employer Share: 3.25% of gross monthly wages (Total Contribution: 4.0% of gross wages). If an employee's average daily wage is up to ₹176, the employee is 100% exempt from contributing, and only the employer pays 3.25%.
