Form 15CA & Form 15CB CA Certification for Foreign Remittances

Under Section 195 of the Income Tax Act, 1961 read with Rule 37BB of the Income Tax Rules, any person making a payment or remitting funds to a non-resident or foreign company must furnish an online undertaking in Form 15CA. If the remittance exceeds ₹5 Lakhs in a financial year and is taxable in India, a formal Certificate from a practicing Chartered Accountant in Form 15CB is legally mandatory before authorized dealer banks can process the outward foreign exchange wire transfer.

TaxQue provides express CA certification and DTAA relief analysis. Our senior Chartered Accountants analyze withholding tax rates under Double Taxation Avoidance Agreements (DTAA), examine Tax Residency Certificates (TRC) and Form 10F, issue certified Form 15CB with valid UDIN, file Form 15CA on the e-filing portal, and coordinate with your bank for immediate foreign remittance clearance.

What is 15CA-15CB Filing?

Form 15CA is a declaration submitted by the remitter online, while Form 15CB is a certified tax determination report issued by a practicing Chartered Accountant confirming whether withholding tax (TDS under Section 195) is applicable on the overseas payment.

15CA-15CB Filing — Form 15CA and 15CB Foreign Remittance CA Certification — TaxQue

Form 15CA Parts Structure (Part A, B, C, D): Part A (Remittances <= ₹5L in a FY), Part B (Orders from AO under Sec 195(2)/197), Part C (Taxable remittances > ₹5L requiring Form 15CB), Part D (Non-taxable remittances under Specified List of 33 items).

Form 15CB (Chartered Accountant Certification): Statutory certification by a practicing CA detailing the nature of remittance, royalty/FTS clauses under DTAA, applicable withholding tax rate, and tax treaty relief.

DTAA Relief & Withholding Tax Optimization: Enables applying lower withholding tax rates (often 10% to 15% under DTAA instead of standard 20% / 40% domestic rates) upon furnishing TRC, Form 10F, and No PE declarations.

Section 271I Penalty Alert

Failure to furnish Form 15CA/15CB or furnishing inaccurate information prior to foreign remittance attracts a mandatory penalty of ₹1,00,000 under Section 271I of the Income Tax Act.

FAQ

Frequently Asked Questions

Quick answers about 15CA-15CB Filing

Under Section 195 of the Income Tax Act and Rule 37BB, any resident individual or business remitting funds overseas to a non-resident or foreign company must furnish Form 15CA (electronic declaration by remitter) and Form 15CB (tax certification by a practicing Chartered Accountant) before the bank will process the outward foreign exchange wire.

Part A is filed if remittance is taxable and does not exceed ₹5 Lakhs in the financial year. Part B is filed if remittance exceeds ₹5 Lakhs with a Section 195/197 lower TDS certificate from the tax officer. Part C is filed if remittance exceeds ₹5 Lakhs and requires a CA certificate in Form 15CB. Part D is filed if the remittance is 100% non-taxable under the specified list of 33 exempt payments.

Form 15CB is compulsory whenever the remittance to a foreign vendor exceeds ₹5 Lakhs in a financial year and the payment is taxable in India (such as for software licenses, royalty, fees for technical services, foreign consultancy, overseas advertising, or equipment import).

Under Section 90(2), the provisions of the DTAA treaty between India and the foreign vendor's country apply if they are more beneficial than domestic tax laws. By collecting a Tax Residency Certificate (TRC) and Form 10F from the overseas vendor, our CAs can legally reduce the TDS rate from 20% down to 5%–10% or achieve 0% tax.

Your Form 15CB is certified and digitally signed by a practicing Chartered Accountant using their unique Document Identification Number (UDIN) generated on the ICAI portal, ensuring 100% acceptance by all Authorized Dealer (AD) banks.
